Settlement in the case PMP Group Nordic and Atilla Engin vs. Djuma Soundsystem.

The first Danish litigation concerning use of samples from existing music works has been concluded.

On September 26th 2011 the Copenhagen City Court ruled in the matter concerning Djuma Soundsystem’s work "Les Djinns". "Les Djinns" contains a sampling from Turkish drummer/composer Atilla Engin’s 1985 composition "Turkish Showbiz".

According to the judgement Djuma Soundsystem was ordered to recognize that Djuma Soundsystem had no right to use their composition because it contained samples from “Turkish Showbiz”. The Copenhagen City Court ordered Djuma Soundsystem to compensate Atilla Engin, his record company, and publisher of app. 750.000 DKK and pay legal fees of app. 110.000 DKK.

Djuma Soundsystem appealed the decision to the Court of Appeal, Eastern Division. Before the appeal was heard the parties agreed to settle the matter amiably. The contents of the settlement are confidential. All parties are satisfied with the result.

Forlig i sagen PMP Group Nordic ApS og Atilla Engin mod Djuma Soundsystem.

Den første retssag om brug af samples fra allerede eksisterende musikværker er nu afsluttet.

Københavns Byret afsagde den 26. september 2011 dom i en sag om Djuma Soundsystems værk ”Les Djinns”. I ”Les Djinns” indgår en sampling fra den tyrkiske jazztrommeslager og komponist Atilla Engins komposition ”Turkish Showbizz” fra 1985.

Ifølge dommen skulle Djuma Soundsystem anerkende, at Djuma Soundsystem ikke havde haft ret til at udnytte sin egen komposition, fordi den indeholdt samplingen fra ”Turkish Showbiz”. Djuma Soundsystem blev af Københavns Byret pålagt at betale ca. 750.000 kr. i erstatning, godtgørelse og vederlag til Atilla Engin og dennes pladeselskab og musikforlag, og sagsomkostninger på ca. 110.000 kr.

Djuma Soundsystem ankede Københavns Byrets dom til Østre Landsret. Landsretten får dog ikke lejlighed til at tage stilling til sagen, da parterne nu er blevet enige om at indgå forlig. Forligets indhold er fortroligt.

Alle parter er tilfredse med resultatet.
